Terms of Service

1. Agreement Overview

This Terms of Use (“Agreement”) establishes a legally binding agreement between Moviq LLC, a Limited Liability Company registered in the State of Wyoming (“Moviq”), and the Customer (“Customer”). By using Moviq’s services, the Customer agrees to abide by the terms, conditions, and obligations outlined in this Agreement. If the Customer does not agree, they must discontinue using the services immediately. Except for ongoing obligations, such as payment for services rendered, the relationship between Moviq and the Customer will conclude upon termination of this Agreement.

2. Service Plans

.Moviq offers three subscription plans, each designed to cater to different levels of creative and marketing needs. The Mini plan provides a set number of creative hours per month with a single active task at a time. The Premium plan offers a full-time creative service with the ability to handle multiple tasks simultaneously. The Elite plan includes an expanded workload capacity and additional services, such as Webflow and Framer development. All plans include unlimited concepts, design, and marketing support, with the flexibility to pause or cancel at any time.

Customers may also request custom quotes for specialized services, including but not limited to:

  • Graphic Design
  • Website Design & Development
  • Digital Marketing
  • Digital Illustrations

Moviq reserves the right to hire external contractors at its discretion to ensure the highest quality work and accommodate additional resource requirements.

3. Cancellation and Renewal Policy

‍Customers may cancel their subscription by submitting a written notice at least twenty-one (21) days before the end of the current billing cycle. Due to resource allocation (including dedicated designers and project managers), Moviq does not provide refunds once work has commenced.

After cancellation, Moviq will continue to provide services until the end of the current billing cycle. No further charges will apply after that. If the notice is provided without the required 21-day period, the subscription will renew for one more billing cycle, and the cancellation will take effect afterward.

4. Acceptance of Work

‍Customers have three (3) business days to review and provide feedback on completed work. If no feedback is received within that timeframe, the work is considered accepted, and Moviq will proceed with the next task.

This does not prevent further refinements, but such revisions will impact the ongoing project timeline or billing cycle.

5. Intellectual Property Rights

Ownership of all work created exclusively for the Customer transfers upon commencement of the billing cycle. This includes custom brand assets, website designs, and digital marketing content. However, Moviq retains ownership of all foundational tools and frameworks, such as design methodologies, proprietary software, and reusable templates.

6. Ownership of Materials

‍Upon full payment, the Customer gains complete ownership of final deliverables, including source files. However, this transfer excludes Moviq’s proprietary methods, tools, or general design elements used during the creative process.

7. Fonts & Third Party Assets

‍If a project requires third-party assets that need a separate commercial license, Moviq will inform the Customer. The Customer is responsible for acquiring the necessary licenses to ensure legal use.

8. Customer Representations

‍By engaging Moviq’s services, the Customer represents and warrants that:

  • They have the legal capacity to enter into this Agreement.
  • They will not use automated or non-human means to access services.
  • They will only use Moviq’s services for lawful purposes.
  • They will comply with applicable laws and regulations.

9. Prohibited Activities

The Customer must not:

  • Resell, redistribute, or commercially exploit Moviq’s work without permission.
  • Use Moviq’s designs in ways that infringe third-party intellectual property rights.
  • Engage in fraudulent, illegal, or unethical activities.

10. Feedback

‍Customer feedback must be provided through designated platforms such as Loom or Figma. Moviq retains ownership of all feedback received and is not obligated to keep it confidential.

11. Oversight

Moviq reserves the right to monitor services for violations of these terms. Moviq may restrict, suspend, or deny access to services without notice if violations occur.

12. Modifications to Terms of Use‍

Moviq reserves the right to modify or discontinue services at its discretion. Customers will be notified of significant changes.

13. Service Interruptions

‍Moviq is not liable for service interruptions due to factors beyond its control, such as technical issues, staff unavailability, or external disruptions. Moviq will notify Customers of major disruptions and resume work as soon as possible.

14. Governing Law

‍This Agreement is governed by the laws of the State of Wyoming.

15. Limitations of Liability and Indemnification

Moviq is not liable for any indirect, incidental, or consequential damages, including lost profits or data loss. The Customer agrees to indemnify and hold Moviq harmless from claims related to their use of the services.

16. Customer Data

Customers must provide all necessary materials and information for Moviq to perform its services. While Moviq will take reasonable steps to protect data, it is not liable for data loss or corruption.

17. Electronic Delivery of Materials

‍Customers agree to receive all communications, agreements, and notices electronically.

18. Showcasing Work

‍Moviq reserves the right to feature completed work on its digital channels unless the Customer requests otherwise through an NDA.

19. Termination

‍This Agreement remains in effect until terminated by either party. Customers may terminate their agreement in accordance with the cancellation policy. Moviq reserves the right to terminate services for reasons such as non-payment or breach of terms.
